1. Acceptance of these terms
These Terms of Service govern your use of the ELH RESALE LLC website and your purchase of products from us. By browsing this site or placing an order you agree to these terms. If you do not agree, please do not use the site.
2. Who may buy from us
You must be at least 18 years old and able to form a binding contract. We sell to individual customers in the United States for personal or household use. We do not knowingly sell for onward wholesale distribution, and we may cancel orders that appear to be placed for resale.
3. Products and condition
ELH RESALE LLC resells consumer products sourced as surplus, overstock, open-box, processed customer returns and pre-owned stock. Items are graded A, B or C and each listing carries a written condition note describing cosmetic wear, included accessories and packaging.
- Unless a listing states otherwise, items are not sold as brand new retail stock.
- Photographs may be representative; the written grade and condition note prevail.
- Manufacturer warranties may be void, expired or non-transferable on resold goods. Any warranty we offer is stated in the listing.
- We are not affiliated with, endorsed by, or an authorised dealer for the brands whose products we resell. Brand names are used only to identify the item.
4. Pricing and availability
Prices are shown in U.S. dollars and exclude applicable sales tax and shipping unless stated. Because resale inventory is limited and often single-unit, availability can change quickly. We reserve the right to correct pricing or description errors and to cancel and fully refund any order affected by such an error.
5. Orders and payment
Your order is an offer to buy. A contract is formed when we confirm dispatch. Payment is taken at checkout through our payment processor. We may decline or cancel an order where we suspect fraud, where stock is unavailable, or where these terms have been breached; in that case any payment taken is refunded in full.
6. Shipping, returns and refunds
Shipping timescales, return eligibility and the refund process are set out in our Shipping & Returns policy, which forms part of these terms. Nothing in these terms limits any right you have under consumer protection law that cannot lawfully be limited.
7. Text messaging terms
Where you opt in, ELH RESALE LLC sends order notifications, customer care replies, account and security messages, and — on separate express written consent — marketing messages, to the mobile number you provide.
- Consent is not a condition of any purchase.
- Message frequency varies. Marketing messages are limited to 4 per month.
- Message and data rates may apply.

- Carriers are not liable for delayed or undelivered messages.
Mobile telephone numbers, text messaging originator opt-in data and consent are never sold, rented, leased, or otherwise disclosed to any third party or affiliate for marketing or promotional purposes.

8. Acceptable use
You agree not to:
- Use the site for any unlawful purpose or in breach of any applicable regulation.
- Attempt to gain unauthorised access to our systems, accounts or data.
- Scrape, harvest or copy site content for commercial use without our written permission.
- Interfere with the operation of the site or with other users' use of it.
- Submit false information, fraudulent payment details, or another person's mobile number.
9. Intellectual property
The ELH RESALE LLC name, logo, site design, text and photographs are owned by or licensed to ELH RESALE LLC and may not be reproduced without permission. Third-party brand names and trademarks appearing in listings remain the property of their respective owners and are used only to describe the item offered for resale.
10. Warranties and limitation of liability
Products are sold in the condition described in the listing. To the fullest extent permitted by law, and except as expressly stated in a listing or in our returns policy, products are provided without further warranty of any kind, express or implied.
To the fullest extent permitted by law, ELH RESALE LLC is not liable for indirect, incidental, special or consequential losses, and our total liability arising out of any order is limited to the amount you paid for that order. Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
11. Governing law and changes
These terms are governed by the applicable federal law of the United States and by the laws of the state in which ELH RESALE LLC is organised, without regard to conflict of law principles. We may update these terms; the revised version takes effect when posted, and the “last updated” date above will change. If any provision is found unenforceable, the remaining provisions continue in force.
